Withdrawal information: Stridewell Plus

Drafting aid for counsel review. Not legal advice. Law as of 2026-10-20. Applies only to EU consumers (Germany, Austria and other EU markets Stridewell sells into). There is no equivalent US withdrawal or cooling-off right under the sources this drafting aid draws on: do not show this document, or any part of it, to a California or New York user as if it created a right it does not have there.

Stridewell Plus is a digital service (ongoing access to the app's paid features), not a one-off supply of digital content and not physical goods, so the services and digital content (subscriptions) variant of the statutory model applies, with the withdrawal period running from conclusion of the contract.

German version (Widerrufsbelehrung), for German users

This is the statutory Muster-Widerrufsbelehrung (Anlage 1 to Art. 246a § 1 Abs. 2 Satz 2 EGBGB), filled in for Stridewell Plus. Using it correctly, in text form, discharges Example Fitness GmbH's withdrawal-information duty. Do not alter the wording below beyond the bracketed placeholders.

Sie haben das Recht, binnen vierzehn Tagen ohne Angabe von Gründen diesen Vertrag zu widerrufen.

Die Widerrufsfrist beträgt vierzehn Tage ab dem Tag des Vertragsabschlusses.

Um Ihr Widerrufsrecht auszuüben, müssen Sie uns (Example Fitness GmbH, Hauptstrasse 1, 89073 Ulm, support@example-fitness.test) mittels einer eindeutigen Erklärung (z. B. ein mit der Post versandter Brief oder eine E-Mail) über Ihren Entschluss, diesen Vertrag zu widerrufen, informieren. Sie können dafür das beigefügte Muster-Widerrufsformular verwenden, das jedoch nicht vorgeschrieben ist. Sie können Ihr Widerrufsrecht auch online unter [web address of the in-app or web withdrawal function — to be confirmed] ausüben. Wenn Sie diese Online-Funktion nutzen, übermitteln wir Ihnen auf einem dauerhaften Datenträger (z. B. durch eine E-Mail) unverzüglich eine Eingangsbestätigung mit Informationen zum Inhalt der Widerrufserklärung sowie dem Datum und der Uhrzeit ihres Eingangs.

Zur Wahrung der Widerrufsfrist reicht es aus, dass Sie die Mitteilung über die Ausübung des Widerrufsrechts vor Ablauf der Widerrufsfrist absenden.

Folgen des Widerrufs

Wenn Sie diesen Vertrag widerrufen, haben wir Ihnen alle Zahlungen, die wir von Ihnen erhalten haben, einschließlich der Lieferkosten (mit Ausnahme der zusätzlichen Kosten, die sich daraus ergeben, dass Sie eine andere Art der Lieferung als die von uns angebotene, günstigste Standardlieferung gewählt haben), unverzüglich und spätestens binnen vierzehn Tagen ab dem Tag zurückzuzahlen, an dem die Mitteilung über Ihren Widerruf dieses Vertrags bei uns eingegangen ist. Für diese Rückzahlung verwenden wir dasselbe Zahlungsmittel, das Sie bei der ursprünglichen Transaktion eingesetzt haben, es sei denn, mit Ihnen wurde ausdrücklich etwas anderes vereinbart; in keinem Fall werden Ihnen wegen dieser Rückzahlung Entgelte berechnet.

Haben Sie verlangt, dass die Dienstleistung während der Widerrufsfrist beginnen soll, so haben Sie uns einen angemessenen Betrag zu zahlen, der dem Anteil der bis zu dem Zeitpunkt, zu dem Sie uns von der Ausübung des Widerrufsrechts hinsichtlich dieses Vertrags unterrichten, bereits erbrachten Dienstleistungen im Vergleich zum Gesamtumfang der im Vertrag vorgesehenen Dienstleistungen entspricht.

Note on the proportional-payment paragraph: this applies only if you let the user start using Stridewell Plus's paid features before the 14-day withdrawal period runs, with the user's own express request and your prior acknowledgment that this means a proportional payment is owed. If your product always withholds paid features until the withdrawal period has run, this paragraph can be dropped, but the more common commercial design (giving immediate access on payment, including during the free trial's paid-conversion moment) keeps it in play. Open point: confirm with product which design Stridewell Plus actually uses before finalizing.

Note on the online withdrawal-function sentence: this is included because Stridewell Plus is concluded through an online interface (the app and/or your web checkout), which triggers the § 356a BGB duty to provide a standing withdrawal function. The bracketed web address must point to an actual, permanently available, prominently placed control in the app or on your website: see the Implementation requirements document for what that control must do. Do not publish this document with the bracket still empty.

Right of withdrawal

You have the right to withdraw from this contract within 14 days without giving any reason.

The withdrawal period will expire after 14 days from the day of the conclusion of the contract.

To exercise the right of withdrawal, you must inform us (Example Fitness GmbH, Hauptstrasse 1, 89073 Ulm, Germany, support@example-fitness.test) of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or email). You may use the attached model withdrawal form, but it is not obligatory. You can also exercise your right of withdrawal online at [web address of the withdrawal function]. If you use this online feature, we will send you an acknowledgement of receipt of the withdrawal on a durable medium (e.g. by email), including its content and the date and time of its submission, without undue delay.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

If you requested to begin the performance of the service during the withdrawal period, you shall pay us an amount which is in proportion to what has been provided until you have communicated us your withdrawal from this contract, in comparison with the full coverage of the contract.

What this document does not cover

  • This withdrawal right does not exist for a US (California or New York) subscriber; do not translate or adapt this document for the US market.
  • This document does not state the standing withdrawal-function and confirmation-function controls your app or website must actually build (the PW-DE-4 "Vertrag widerrufen" / PW-DE-5 "Widerruf bestätigen" labels and their mechanics); those requirements are in implementation-requirements.md under "Withdrawal."
  • This document does not address what happens if your 7-day free trial converts to a paid subscription before the 14-day withdrawal period on the underlying contract has run; see the open point above on the proportional-payment paragraph, and confirm with counsel whether the trial conversion itself should be treated as the "early performance" this document's proportional-payment clause addresses.
